Terms of Service Please read these Terms and Conditions (“Terms”) carefully. By accessing or using Elevate Washington or any content made available through https://www.elevatewashington.org (the “Website”), you agree to be bound by these Terms and the Elevate Washington Privacy Policy.
Any new content, features, or tools added to the Website will be subject to these Terms. SOWA reserves the right to update and change these Terms in its sole discretion. All changes to the Terms are effective once posted on the Website. You are advised to check the Terms from time to time for any updates or changes that may impact you. If you do not agree with any revisions to the Terms, you should discontinue your use of the Website and Elevate Washington.
User Obligations You may not use the Website or other services provided by Elevate Washington for any unlawful or unauthorized purpose or in a manner inconsistent with these Terms. You will comply with all applicable laws, rules and regulations in your use of Elevate Washington and the Website. You must not do anything that could interfere with or impair the proper working of the Website or Elevate Washington.
SOWA may terminate your access to the Website and/or other services provided by Elevate Washington, without cause or notice. Terms regarding ownership and restrictions on use, limitation of liability, indemnification, and disclaimer shall survive termination of the Agreement.
Ownership and Limitations on Use You acknowledge that SOWA has invested substantial resources in compiling data, designing, creating, and maintaining the Website and any other services provided by Elevate Washington. The Website and other services provided by Elevate Washington, including without limitation all original content, compilations of data, features, and functionality, are owned by SOWA and are protected by copyright, trademark, trade secret, and other intellectual property or proprietary rights laws to the fullest extent allowed by law. Certain names, words, titles, phrases, logos, icons, graphics, designs, or other content on the Website and other services provided by Elevate Washington are trade names or trademarks owned by SOWA or third parties, and may not be used without permission.
For the purpose of these Terms, the term “Material” means any material available to you through the Website or other services provided by Elevate Washington, including, without limitation, all text, images and graphics of any nature whatsoever, regardless of whether the copyright and/or database right or any other intellectual property rights in the material vest in SOWA or third parties.
SOWA grants a limited non-exclusive non-transferable revocable license to you to use the Website, other services provided by Elevate Washington, and the Material solely for personal, non-commercial purposes. Your use must not involve the exchange of money, must not promote a business entity (including non-profit organizations), and must not directly or indirectly result in financial gain. You may download or print extracts from the Material and make copies of these for your own personal, non-commercial use only. You must not download, print, or make copies of the Material, or extracts from it, for any other purpose. For example, you must not create a database (in electronic or paper form) comprising all or part of the Material; reverse, decompile, disassemble or otherwise reverse engineer the whole or part of the Material; merge with, transmit to, or store in any other website, any part of the Material in any other form; or otherwise disseminate the Material, or extracts from it.

SOWA respects the intellectual property rights of others. If you believe your protected work was posted on the Website or another service of Elevate Washington without authorization, you may submit a notification with all details to SOWA at info@elevatewashington.org. Notifications should only be submitted by the owner of the work or an agent authorized to act on the owner’s behalf.
Modifications to the Website or Elevate Washington SOWA reserves the right to modify or terminate, temporarily or permanently, the Website or Elevate Washington, for any reason, at any time, with or without notice to you. You agree that SOWA will not be liable to you or to any third party for any modification, suspension, or termination of the Website or Elevate Washington.
Limitation of Liability, Indemnification, and Disclaimer You expressly understand and agree that SOWA or any third parties mentioned on the Website shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use of or inability to use the Website or Elevate Washington. Direct damages are limited to ten dollars.
You agree to defend, indemnify, and hold harmless SOWA, its affiliates, directors, officers, employees, consultants, and agents from any costs or damages of any kind, including reasonable attorneys’ fees, arising from a claim, action, demand, liability, or settlement made by any third party relating to (i) your use of the Website or Elevate Washington, (ii) your breach of these Terms, or (iii) your violations of any applicable laws or regulations or rights of another.
The Website and Elevate Washington are provided “as is” and “as available” without any warranties, representations, or conditions of any kind, whether express or implied. Specifically, SOWA makes no representations, warranties, or guarantees that the Website or Elevate Washington, including any Material or information on either, will be uninterrupted, timely, secure, accurate, updated, or reliable. Further, the listing of any particular organization, site, or program on the Website or Elevate Washington does not imply endorsement by SOWA and does not imply the suitability, availability, quality, or capacity of the organization, site, or program. It is solely your responsibility to investigate and ascertain whether a particular organization, site, or program fits your circumstances and needs.
Links The Website may link to other sites operated by third parties. The inclusion of any link to such sites does not imply endorsement by SOWA of the sites, and is for your reference and convenience only. SOWA has no control over the third-party sites to which its Website links or the content on those sites. General These Terms and the relationship between you and SOWA will be governed and construed by the laws of the State of Washington and the applicable laws of the United States of America, without regard to conflict of laws provisions. You hereby consent and submit to the personal and exclusive jurisdiction of the state and federal courts of the State of Washington in any action or dispute related to these Terms. The failure of SOWA to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms and other terms herein incorporated by reference, and (if applicable) the agreements you enter into when creating an account and when submitting data to Elevate Washington, constitute the entire agreement between you and SOWA, and govern your use of the Website and Elevate Washington, superseding any prior agreement, whether oral or written.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms remain in full effect.
